OFFICIAL CONTEST RULES
The Call2Recycle TipZone contest (the “Contest”) takes place at Science World (located at 1455 Quebec St, Vancouver, B.C.) and is open to British Columbia residents only. Eligible participants will entered in a random draw (odds of winning determined by the number of eligible entries received). No purchase is necessary, but a skill-testing question is required. Entry in the Contest constitutes acceptance of these Contest Rules.
1. CONTEST PERIOD:
Contest runs Wednesday, April 24, 2013 from 9:30 a.m. to 11:00 a.m. Pacific Time (“Contest Period”) during the Call2Recycle Event (“Event”) taking place at Science World, located at 1455 Quebec Street in Vancouver, B.C.
Contest is open to all legal residents of British Columbia, Canada who have reached the legal age of majority in in British Columbia (19) at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Call2RecycleCanada Inc., the “Sponsor”, Science World, and their respective affiliates, marketing partners, suppliers, advertising or promotional agencies, or prize suppliers (collectively the “Contest Parties”).
The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading.
The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
3. HOW TO ENTER
Eligible participants must complete the following steps to be entered in the Contest. NO PURCHASE is necessary to enter this Contest.
To enter, submit a completed Contest Entry Form, which requires you to enter your full name, address, valid email address and telephone number and signify your agreement that you agree to be legally bound by the terms and conditions of these Official Rules and Regulations. Once you have fully completed the Entry Form with all required information, submit your completed Entry Form at the Event (the “Entry”). To be eligible, your Entry must be submitted and received within the Contest Period. All eligible Entries submitted and received during the Contest Period will be entered into the random prize draw.
Limit one (1) Entry per person. If it is discovered that you attempted to enter more than one time during the Contest Period, then in the sole and absolute discretion of the Sponsor, you may be disqualified from the Contest and all of your Entries may be voided.
At the Event, the Sponsor will welcome the submission of batteries for recycling. However, the submission of a battery is not required to enter the Contest. Batteries weighing more than five (5) kilograms, are wet-cell or car batteries will NOT be accepted for recycling.
Participation in the Contest constitutes the participant’s full and unconditional agreement to and acceptance of these Official Contest Rules. Participants who do not comply with these rules may subject to disqualification, in the sole and absolute discretion of the Sponsor. The Sponsor reserves the right to reject invalid, incomplete, or late Entries or Entries otherwise not complying with these Official Contest Rules.
All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Sponsor’s official clock.
4. CONTEST PRIZES
There are three (3) prizes available to be won in this Contest as follows:
- One (1) Science World Family pass (approximate retail value $185 CAD, valid for one year from date of issue, to be awarded in the form of a $185 gift certificate to Science World (“Science World Pass Prize”));
- Four (4) tickets to a BC Lions home game (approximate retail value $170 CAD (“Ticket Prize”)); and
- One iPod nano mobile digital device (approximate value $145 CAD (“iPod Prize”))
Collectively, the Science World Pass Prize, the Ticket Prize, and the iPod Prize are “Prizes”. iPod nano is a registered trademark of Apple Inc. Apple is not a sponsor of, nor a participant in this Contest.
Potential winners will be contacted by the Sponsor with instructions on how to claim the applicable Prize. All Prizes must be accepted as awarded. The Prizes may not be sold, transferred and are not convertible to cash. The Sponsor reserves the right, in its sole and absolute discretion, to substitute a prize of equal or greater value if a Prize (or any portion thereof) cannot be awarded for any reason. Prize winners are solely responsible for all costs not expressly described herein, and the Sponsor shall not assume any liability for lost, damaged or misdirected Prizes. Prize will only be awarded to the person whose verifiable full name and valid email address appears on the Entry Form associated with the Entry in question.
5. WINNER SELECTION PROCESS
At or about 11:00 a.m. PT on Wednesday, April 24, in Vancouver, British Columbia, a random draw (“Draw”) will be held by a representative of the Sponsor, from among all eligible Entries submitted and received during the Contest Period in accordance with these Rules to select three (3) eligible entrants. The first entrant so selected shall be eligible to win the Science World Pass Prize, the second entrant so selected shall be eligible to win the Ticket Prize, and the third entrant so selected shall be eligible to win the iPod Prize. The Odds of being selected as a potential winner depend on the number of eligible Entries received during the Contest Period.
Sponsor or its authorized representative will announce the potential winners following the Draw, and if the potential winner (or the potential winner’s child if applicable) is not present at the Draw, will attempt to contact each selected Entrant by email or phone once per day for three (3) consecutive business days after the draw. in such a case, the selected Entrant will have a further three (3) consecutive business days to respond via email, phone or voicemail. If the selected Entrant does not respond as required under this Rule, or responds but is deemed to be ineligible in Sponsor’s sole discretion, or is unable or unwilling to comply with these Official Rules, that selected Entrant will be disqualified and forfeit all rights to the applicable Prize, and the Sponsor reserves the right to randomly select another potential winning Entrant from the remaining eligible Entries, in which case the foregoing provisions of this rule shall apply to such newly selected entrant. Sponsor is not responsible for any change in an Entrant’s contact information or for any failure whatsoever of Entrant to receive Sponsor’s notification or for Sponsor to receive a selected Entrant’s response. If the potential winner, or potential winner’s child is present at the Draw, the Sponsor will take a photo of the potential winner or the potential winner’s child (as applicable) for promotional purposes. If you are the parent/legal guardian of a minor child who attends the Event and submits your Entry, you expressly agree to your child being photographed for this purpose if you are selected as a potential winner.
Before being declared a winner, each selected potential prize winner shall be required to have correctly answered, without assistance of any kind, mechanical or otherwise, a time-limited mathematical skill-testing question, which may be on the entry form, or may administered during a pre-arranged telephone call or by e-mail. Sponsor may also require the potential winner to sign and return a Release (described below) before being declared a winner.
Sponsor reserves the right to require a selected entrant to sign and return the Sponsor’s declaration and release form, on the timeline specified in the form before being declared a confirmed winner, which (among other things): (i) confirms eligibility and compliance with these Official Contest Rules; (ii) acknowledges acceptance of the applicable Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.
If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) if requested fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the applicable Prize as awarded for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).
7. GENERAL CONDITIONS
By entering this Contest, all participants automatically agree to accept and abide by these Rules. All decisions of the Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of Entries or entrants, are final and binding on all entrants in all matters as they relate to this Contest. If for any reason, in the opinion of the Sponsor, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is adversely affected, the Sponsor reserves the right to cancel, terminate, modify, amend, extend or suspend the Contest.
The Sponsor reserves the right to modify the Rules without materially affecting the terms and conditions. The Sponsor reserves the right in its sole and absolute discretion to disqualify any individual found to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. The Released Parties shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest.
The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of British Columbia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Entry in question.
By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling this Contest.
In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contests entry form, or point of sale, television, print or online advertising, the terms and conditions of these Contest Rules shall prevail, govern and control.
10. INTELLECTUAL PROPERTY
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
By participating in the Contest by submitting an Entry, you:
(a) consent that your personal information (including your name, email address, telephone number, country of residence and, in the event that you are selected as the Contest winner, your full mailing address, photograph, voice, likeness and/or statements) is being collected by Sponsor for the purposes of operating, administering and promoting the Contest;
(b) grants to the Sponsor the right to use your personal information for publicity and promotional purposes relating to the Contest in any and all media without further compensation unless prohibited by law
The consents listed above are effective as of the date on which you submit your Entry.
Your personal information is collected, used and disclosed pursuant to sections 26 (c) and (d) of the Freedom of Information and Protection of Privacy Act (BC) for the purposes of administering this Contest. Your personal information will be kept confidential and will not be shared with any third parties, except as necessary for the operation, administration and promotion of this Contest in accordance with these Official Rules or as may be required by law.
